Judge sentences Moscow man to life for wife's murder

MOSCOW, Idaho – Charles Capone was sentenced to life in prison plus 20 years in prison for the murder of Rachel Anderson on Monday.

Judge Kerrick sentenced Capone to a fixed life sentence plus twenty years for two other convictions. He will not be eligible for parole.

Judge Kerrick called Capone a "risk to society," and stated that Capone was a repeat offender.

Capone was convicted in 2014 for the murder of Rachel Anderson in 2010.

Capone's lawyer argued against statements made to the police found in the pre-sentencing report, but the judge stated he would only be focusing on evidence presented at the trial and the jury's findings in terms of sentencing.

The prosecution argued for a life sentence, stating that Capone is a habitual offender and a manipulator.

"Charles brought darkness. Today, he will be judged for his actions," said one of Anderson's family members.

Members from Capone's church spoke, saying he was a kind and compassionate person.

Capone's lawyer spoke about his criminal history, but said that Capone sought help after an incident with his previous wife.

The detention deputy that oversaw Capone in prison also testified, stating that although Capone was a good inmate, he did not express regret for the murder of Anderson.

Capone showed little emotion throughout the hearing, and looked down the entire time. When he did stand to speak, he maintained his innocence and claimed the trial was a "popularity contest."

"This case has been a lie to the public," said Capone. He continued to state that he felt there were only accusations in the case, but no facts.
