Murder conviction of daycare operator upheld

BOISE -- The Idaho Supreme Court has upheld the first-degree murder conviction of a former Boise daycare operator sentenced to life in prison for killing a 2-year-old boy who refused to take off his coat.

The court on Wednesday rejected two arguments made by 61-year-old Katherine Stanfield in her appeal of her June 2012 conviction.

Stanfield argued that the lower court erred by allowing the prosecution's expert witness to testify about the victim's brain tissue, and that the court failed to properly instruct the jury about first-degree murder by aggravated battery on a child under 12.

Prosecutors alleged Stanfield violently slammed the boy's head into a hard object three times in December 2009, and the boy died as a result several days later.

Stanfield will be eligible for parole in 2022.
