EMMETT -- The Gem County prosecuting attorney, Richard Linville, said he will not seek the death penalty against Douglas Anderson.
Idaho State Police arrested Anderson in September after 78-year-old Darole Carpenter was found dead in his Emmett home.
On July 8, police believe Anderson beat Carpenter in the head and stabbed him several times in the stomach.
Police say Anderson defrauded Carpenter of about $30,000 and killed him to cover up the crime.
Anderson remains in the custody of the Gem County Sheriff at this time.
