BOISE COUNTY The stepfather of a 4-year-old killed in a car crash off Arrowrock Road in the summer of 2012 will spend up to 10 years in prison for vehicular manslaughter, according to Boise County prosecutors.

Judge Patrick Owen handed down the sentence today for 32-year-old David Leroy Persons. Persons was also charged with DUI and driving without privileges, but prosecutors dropped those charges in a plea deal.

The judge gave Persons a 10-year sentence, with two years fixed, but ordered him into a prison rider program that could last up to one year. He will undergo an evaluation by the Idaho Department of Correction and that could impact how much time he ends up spending behind bars.

Persons was arrested and charged in connection with the death of 4-year-old Pearl Sittner.

The Boise County Sheriff s Office says Persons was driving a SUV with a family of five inside when the vehicle plunged off Arrowrock Road on the evening of Aug. 9, 2012. The SUV went about 90 feet down an embankment and came to rest on some rocks. Persons and three others made it out of the SUV before it broke loose and plunged into the reservoir near Arrowrock Dam. Pearl was trapped in the vehicle and drowned.

Investigators say Persons was fighting with his wife prior to the crash and had a blood alcohol level that was above the legal limit. The girl s mother, Tori Miller, told KTVB that another car had run them off the road.
