BOISE -- A state court has delayed a hearing scheduled for an Eagle attorney accused of abusing two children and committing them to a mental health facility to keep them from cooperating with investigators.

Court officials say arraignment for the 55-year-old Gregory Vietz will be held Friday in 4th District Court.

The delay came after Judge James Cawthon recused himself from the case. The defendant's former wife once worked for the Ada County Prosecutor's office and had cases in Cawthon's court.

Judge Theresa Gardunia has been assigned to the case.

Prosecutors say Vietz physically, sexually and mentally abused his 15-year-old daughter and 14-year-old son before admitting them to the mental health facility.
