BOISE -- Two men are accused of dealing guns in a Boise Fred Meyer parking lot. They are now facing federal charges.

In federal court documents, the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) says Philip Bernardino Chavez and Ronald Keith Alexander sold weapons to an undercover officer in December.

Chavez is charged with possession of an unregistered firearm. ATF agents say he illegally possessed and transferred a machine gun to another person.

Court documents say on two separate Tuesdays in December, the men met up with an undercover officer at the Fred Meyer on Orchard and Franklin.

Federal agents say that in one of the instances, the men sold the officer the modified machine gun and magazines. Court documents explain the weapon, a Pioneer PPS43-C, 7.62x25mm Tokarev, had the single-fire catch removed, making it automatic and in effect a machine gun by legal definition.

Alexander and Chavez were immediately arrested after the operation. Chavez had his initial court appearance this week and was then released from jail.
