BOISE -- A Boise man is charged with excessive DUI and five counts of injury to a child after being stopped by Boise Police officers Saturday night.
Just before 11 p.m., officers say the driver of a Honda Accord made a wide turn from N. Maple Grove Road onto Goddard Road. The driver did not use a turn signal and failed to maintain his lane. Also, the front tire on the driver's side of the vehicle was flat. Officers stopped the car at Goddard Road and Vera Street.
Police say the driver, Cory Ashbaker, 35, smelled of alcohol, his eyes were red and watery and he spoke with slurred speech. He failed field sobriety tests and his blood alcohol content was measured at .222/.214, making the charge aginst him enhanced DUI.
Officers found five children between the ages of 8 and 11 in the car. Only three of them were wearing seat belts. Because of the danger to the kids, Ashbaker was also charged with five misdemeanor counts of injury to a child. He was booked into the Ada County Jail, but has since posted bond and been released.
All five children were placed into safe custody.
