CALDWELL -- Prosecuting Attorney Shelley Akamatsu says she plans to drop a false evidence charge against the former Canyon County prosecutor, but she will continue to press her claim that John Bujak was in contempt of court.
Bujak resigned from his prosecutor post in 2010 after county officials said he failed to reimburse them for resources used in meeting the Nampa prosecution contract.
Bujak was charged with misuse of public funds and he was found not guilty, but then he was charged with fabricating an email to help his defense in the public funds case.
The false evidence case resulted in a mistrial in February.
The Idaho Press-Tribune reports Akamatsu filed documents with the court Monday saying she doesn't intend to proceed to trial again on the false evidence charge.
