BOISE -- An Idaho wind developer that's suspended projects and is struggling to pay its bills faces a new challenge: A lawsuit for missing millions in deposits on turbines it agreed to buy just months ago.
Exergy Development Group LLC of Boise was sued in U.S. District Court last week.
AES New Creek says Exergy hasn't made good on a contract worth up to $37.9 million for 32 turbines.
The plaintiff alleges Exergy signed the contract on May 25 and made an initial, non-refundable deposit of $1.7 million on May 30.
But the company missed a second deposit of $8.7 million on June 5.
Earlier this month, Exergy announced it halted 116 megawatts of Idaho wind developments.
And it's also behind on payments to cycling events it's sponsored to publicize its brand.
