BOISE -- A Boise Police officer is behind bars after being arrested for misdemeanor domestic violence.

The Boise Police Department says Gary Miller, 43, was arrested around 5 a.m. Friday at an east Boise home.

The arrest was made by an Ada County Sheriff's deputy.

Boise Police also charged Miller with assault or battery upon certain personnel Friday morning. They say the additional charge involved an employee of the Ada County Sheriff's Office and happened during the investigation.

This is not the first arrest for Miller while on the Boise Police force.

In August of 2009, he spent three days in the Elmore County Jail after being convicted of driving under the influence.

An Idaho State Police trooper pulled him over in April of 2009 at Curtis and Irving in Boise. His blood alcohol level tested twice the legal limit.

In addition to criminal proceedings, Miller is subject to an internal investigation regarding applicable policies of the Boise Police Department.

According to BPD, Miller has been a Boise Police Officer for 16 years. He is currently assigned to the Bench Patrol Division.

Miller is being held at the Ada County Jail. He faces charges of assault and domestic violence. He's scheduled to be arraigned on Friday.
