BOISE --A former Idaho state senator has been arrested by Ada County Sheriff's deputies for the second time in the last 12 months.

John McGee surrendered himself to deputies at the Ada County Jail around 6:30 p.m. Tuesday. According to a spokesperson with the Ada County Sheriff's Office, he was subsequently arrested.

The Ada County Prosecutor's Office issued an arrest warrant for McGee earlier in the day. The warrant charged McGee with disturbing the peace and violating his probation.

McGee, who's become known for a bizarre string of crimes related to a DUI he received last Father's Day, has struggled through controversy in his public and personal life ever since.

In a seperate incident, McGee resigned from the Idaho state senate in February 2012 after a female staffer alleged she was sexually assaulted by McGee. A subsequent investigation by the Idaho State Police led to the newest charges McGee is accused of.

That investigation, according to the Ada County Prosecutor's Office, found that McGee used profane language and offensive conduct in the presence of the female legislative staffer in question. The incident took place on February 7th at McGee's former Statehouse office.

Ada County Deputy Prosecuting Attorney Roger Bourne said these charges don t typically warrant an arrest, but this recent charge coupled with the fact that McGee is still on probation, means an arrest is needed.

Bourne also says the courts will handle both cases as one.

We have asked the judge to consolidate these cases for plea and sentencing, so we expect there to be a plea for these and sentencing to be held in front of the judge at the same time. So that is the direction we expect this to go, said Bourne.

McGee had been placed on one year of unsupervised probation which would have expired on July 1st.

Ada CountySherrif's Office spokeswoman AndreaDeardon said McGee immediately bonded out on the two $1,000 misdemeanor warrants and was released Tuesday night.

McGee is still employed as the Director of Marketing for the West Valley Medical Center in Caldwell.

He is due in court on Aug. 21 to face the misdemeanor charges.
