Craig to file appeal today

BOISE - Senator Larry Craig said Sunday he and his attorneys will file an appeal this morning, after a judge earlier denied Craig’s earlier attempt to overturn his guilty plea.

During the taping of an interview with KTVB’s Mark Johnson, Craig again stated he would not resign his post in the Senate, and vowed to continue to work his legal options. 

“We don’t know what the appellate court will say to me,” Craig said. “Honestly, the appeals courts tend to defend the courts below them.  It is my right to do what I’m doing.  I’ve already provided for Idaho certainty that Idaho needed, I’m not running for reelection.  I’m no longer in the way. I am pursuing my constitutional rights.”

Craig pleaded guilty to disorderly conduct for a series of events that happened in a Minnesota airport bathroom in June.  After the arrest and plea became public, Craig began proceedings to revoke the plea.

A judge in Minnesota refused to vacate the plea, saying Craig's plea "was accurate, voluntary and intelligent, and supported by the evidence."
