Boise man found guilty of attempted rape

Stephen Newman, 32, has been convicted of attempted rape.

BOISE -- An Ada County jury has found a Boise man guilty of attempted rape, even though he never made physical contact with his intended victim.

Prosecutors say 33-year-old Stephen Newman tried to lure a Boise woman to a local park with an ad on Craigslist for a free iPod.

Gretchan Heller, 28, thought the ad was suspicious and brought her husband with her to McDevitt Park in Boise on July, 27, 2007.

Newman had told her to go to the porta-potty there to claim the free iPod. He claimed his wife had cheated on him so he was giving away her iPod.

When she arrived at the park Heller spotted Newman’s red SUV with the lights off next to the porta-potty. She left and called police.

When officers arrived they found Newman wearing a black stocking cap and ski gloves.  They also found a bb gun, knife and laptop computer in the vehicle.

Newman was originally charged with having a concealed weapon and being in a public park after dark.

He did not take the stand in his own defense during the trial.

The jury took less than three hours to reach a verdict. Newman did not react as the verdict was read aloud.

He will be sentenced on Sept. 5 and could face up to 15 years in prison.
