Eagle couple accuses builder of overcharging

EAGLE -- An Eagle couple says their builder, who is also their neighbor, schemed tens of thousands of dollars from them while constructing their home in Eagle's Two Rivers subdivision.
The couple claims the builder overbilled them for supplies and made fraudulent invoices.
Robert Moffat of Moffat and Moffat Construction is accused of four felony counts of forgery.
David and Jody Zanecki say they had a cost-plus agreement with Moffat.
The Zaneckis would pay the cost of supplies, plus 10 percent for Moffat's work.
Attorneys for the Zaneckis say his clients realized there was a problem when they compared their invoices to another client of Moffat's.
The two couples realized they had the exact same invoices -- for different work.
Original invoices were subpoenaed by the couple’s attorney Dennis Charney, who says what he discovered was overbilling and fabricated invoices.
“Here is another example, here is the invoice that was submitted to my clients for excavation work, so they pay $20,480. What the real invoice was $18,480, the difference is that Hard Rock Construction gave my clients a credit of $2,000.32, and if you line the invoices side by side, they are the identical invoices, but someone whited out on one and the added in new number," said Charney.
We tried to contact Robert Moffat at his home and business today, but he did not return our calls.
Moffat is expected to make a plea in court on July 25th.
The maximum sentence for felony forgery is up to 10 years in prison.
