IRS drops part of case against legislator

COEUR D'ALENE -- The Internal Revenue Service has dismissed part of its case against a state lawmaker who refused to pay income taxes for seven years.

The dismissal in U.S. District Court this week no longer requires Hayden Republican Rep. Phil Hart to disclose names of people who bought his self-published books that detail hisinterpretation of the 16th Amendment and federal tax law.

Hart said Friday he provided the IRS with financial information it requested.

He says providing the names of book buyers would have violated his First Amendment and privacy rights.

It is estimated that Hart owes nearly $90,000 in back taxes, penalties and interest.

Hart paid no income tax between 1996 and 2003.
