CALDWELL -- Cesar Rojas, the suspect accused of pulling the trigger on the night of May 17th at a Caldwell gas station, appeared in court Monday afternoon.
He is charged with aggravated battery and resisting and obstructing an officer.
New court documents say the 22-year-old victim was shot in the hip.
The victim says Rojas flashed a gang sign and then shot him with a semi-automatic pistol.
