BOISE -- A man arrested for marijuana possession several years ago has failed to convince the Idaho Court of Appeals he can't be prosecuted on drug charges because he used the pot as a religious sacrament.

Court documents show 53-year-old Cary William White of Boise had argued that marijuana was a natural product and gift from his creator. White said he entered "into the experience of Marijuana with the intent to bless it."

The appellate court, however, ruled Wednesday that his use of the drug was not substantially motivated by religious belief, agreeing with two lower court decisions.

White plans to appeal to the Idaho Supreme Court.

Boise police arrested White in 2007 after he was pulled over for a faulty headlight and officers found marijuana and a pipe in his vehicle.
