BOISE -- A panel from the Ninth Circuit Court of Appeals will be in Boise next Tuesday to hear an appeal from Eric and Corrissa Mueller, who claim police and doctors violated their rights by giving their infant daughter a spinal tap.

Back in 2002, the Muellers took their five-week-old baby to the emergency room at St. Luke's, wanting to make sure she didn't have a serious illness.

They say a doctor and police officer threatened to take the baby away if they didn't consent to a spinal tap.

The Muellers sued the hospital and the City of Boise in U.S. District Court, where a jury ruled against the couple in 2010.
