Kuna shooting victim: 'All I could see was puddles of blood'

KUNA -- A man who was injured in an overnight shooting in Kuna is speaking from his hospital bed about the altercation that nearly claimed his life.

According to the Ada County Sheriff's Office, the shooting happened at about 1:30 a.m. Thursday outside a house in the 3300 block of East Deer Flat Road.

Damian M. Barber, 19, is accused of shooting another 19-year-old, Elston Herzog, with a .22 rifle during an argument.

Herzog was taken to a Boise hospital, where he's recovering after undergoing surgery. 

"I got shot one through the elbow and then the other two on my pelvis," Herzog told KTVB.

Deputies say Barber and the victim had been arguing via text messages earlier in the night. The argument continued in person outside the Deer Flat Road home.


Herzog says Barber had been sending threatening text messages to his sister. He told KTVB that he went to Barber's house, with his sister and her husband, to confront him and ask why he was being disrespectful.

Herzog told KTVB that while he and his sister were walking up towards the house, Barber came out with a .22 rifle and started shooting.

"Well what I thought it was just like a little pellet gun or something, until he got closer and fired off a couple rounds, and I kinda just stood there, and my thought was he wasn't actually going to use it," Herzog said.

It was a situation that became real, once Herzog says he felt a sharp pain in his side and fell to the ground.

"All I could see was puddles of blood on the ground, and I was like 'I don't know where I'm hit. All I know is this side hurts," Herzog said.

According to the sheriff's office, Barber fired at least three shots at Herzog after the fight turned physical.

Several people with Herzog put him in a car and began driving him toward a hospital. The vehicle was stopped by deputies, who called paramedics to transport him to a local hospital.  

"Now, that I look back probably shouldn't have been there. Probably should have just left it alone," Herzog told KTVB.

Barber was taken into custody at the home, and has been booked into the Ada County Jail on an aggravated battery charge. 

He is due to appear in court Friday afternoon. If convicted, he could face up to 15 years in prison.
