CANYON COUNTY -- A Canyon County man was arrested Tuesday after detectives say he took a photograph of an underage girl while she was showering.
Brian Michael Hughes, 49, faces a felony count of sexual abuse of a minor under the age of 16.
The girl told her mother she was taking a shower Monday when she saw Hughes open the bathroom door, angle his phone at her and take a photo, according to court documents.
Hughes and the victim are known to each other, according to the sheriff's office.
The girl said she later saw the nude photo of herself on the suspect's phone, but detectives say the photo had been deleted from his gallery and the phone's trash bin recently emptied when they checked.
According to court documents, Hughes told another person that he had taken the photo because he was "curious" but denied that he was sexually motivated and said he later deleted it.
Hughes also admitted taking the photo to detectives, telling them it was a mistake, according to court documents. In an apology letter Hughes wrote to the girl, he stated "it was the dumbest thing [he] had ever done" and that he "takes all responsibility."
Hughes was arrested and booked into the Canyon County Jail, but was later released on a $15,000 bond. He is due back in court Oct. 4.
If convicted, Hughes could face up to 25 years in prison.
