Rupert man sentenced for child abuse death

RUPERT -- A 25-year-old Rupert man has been sentenced to 3 1/2 years in prison in the 2008 death of his infant daughter.

The Times-News reports Jaime Lopez pleaded guilty to felony injury to a child under an agreement that requires him to testify truthfully at the mother's trial on the same charge. Teresa Oriana Martinez's trial is set for June.

Three-month-old Nivea Lopez died in December 2008 of abusive head injuries.

Prosecutors have said both parents had custody of the child when she was critically injured, but the state did not have enough evidence to charge either with murder.

The sentence Lopez received Monday will run concurrently with a two- to 10-year term he received for violating his probation on a statutory rape conviction for his relationship with Martinez.
