BURLEY, Idaho -- A prosecutor in southern Idaho has decided not to file criminal charges against a Heyburn man involved in a fatal crash in a factory parking lot.
Cassia County Prosecutor Al Barrus says for now nothing will be filed against Daniel Hood, who crashed head-on into a truck driven by 59-year-old Santiago Maestas in March.
Maestas was killed in the collision at the McCain Foods USA plant west of Burley.
Barrus tells the Times News one complication in the case was meeting the legal criteria for pursuing voluntary manslaughter.
He says state law requires an accident to have occurred on a highway, street, bridge or on public or private property open to the public. In this case, the crash took place on private property not accessible by the public.
