LEWISTON -- The attorney for a northern Idaho woman charged with killing a 2-year-old girl has asked a judge to dismiss a grand jury's indictment contending misconduct by the prosecutor at the grand jury proceeding.

The Lewiston Tribune reports that Lewiston attorney Richard M. Cuddihy filed a motion Thursday asking that the first-degree murder charge against 29-year-old Natasha Hodges be dismissed.

Cuddihy says misconduct by Nez Perce County Senior Deputy Prosecutor Sandra K. Dickerson was "so blatant and severe that it was prejudicial."

The grand jury in April indicted Hodges on a first-degree murder charge in the Aug. 30 death of Rylee Mingo. Hodges has pleaded not guilty.

Prosecutors say the girl died of internal bleeding on Aug. 30 after being struck in the abdomen by Hodges.
