MURPHY, Idaho -- A 29-year-old Homedale woman pleaded not guilty Friday to a charge of destroying evidence, by burning the body of her 2-year-old daughter.
Veronica Herrera told police last month her daughter fell and hit her head, and later she found the girl wasn't breathing. She said she burned the body to try to avoid losing her other two children.
Herrera was led into an Owyhee County Courthouse Friday morning. She didn't say anything, instead, she let her lawyer enter a not guilty plea.
Judge Thomas Ryan detailed the grisly accusation. "You've been charged by the Owyhee County Prosecuting Attorney with the offense of destruction of evidence... by purchasing lighter fluid and/or accelerant, by placing the body in a burn barrel, and spraying the body with the fluid, and lighting the body on fire."
Herrera's trial is set for late January. If found guilty, the maximum sentence Herrera would face is 5 years in prison and a $10,000 fine.
