NYSSA, Ore. -- The Malheur County Sheriff's Office is investigating a deadly shooting in Nyssa.

Malheur County Sheriff Brian Wolf says they received a call just after 5 p.m. Monday that 36-year-old Charles Fanning had shot an intruder on the roof of his home.

Wolf says when officers first arrived on scene, they found 31-year-old Mike Perez of Nyssa unconscious.

Medics tried to revive him, but Perez was pronounced dead at the scene.

Investigators returned to the scene Tuesday after serving a search warrant. Any evidence gathered will be sent to a state crime lab.

Wolf says an autopsy is planned on the victim either today or tomorrow.

Once the investigation is complete, it will be turned over to the Malheur County district attorney to determine if any charged will be filed against Fanning.
