BOISE -- When a northern Idaho man convicted of drug charges told his attorney moments after the verdict to "appeal everything," a court has found he meant it.

The Idaho Court of Appeals sided Wednesday with Kirk Julliard Gosch, who argued that his attorney failed to follow his order and fight the guilty verdict. The new decision means Gosch will get another chance to appeal his conviction on charges of marijuana possession and manufacturing a controlled substance.

The Spokesman-Review reports a district court previously found Gosch was at fault. While he said "appeal everything" immediately after his conviction, Gosch also failed to later meet with his attorney, who asked him to set up an appointment to discuss "exactly what he wanted to appeal."

The appellate court found Gosch's counsel was deficient.
