POCATELLO -- A Rexburg businessman has been charged in federal court with knowingly storing and disposing hazardous waste on his property illegally.
Federal prosecutors say 71-year-old Max Spatig pleaded not guilty to the charge in court Wednesday.
Spatig was charged in a one count indictment in December with storing more than 3,400 containers of hazardous waste on his property in July 2010. The waste was later shipped to a proper disposal site at a cost of more than $498,000 paid by the federal government.
Neither Spatig nor his business, MS Enterprises, had a permit from the EPA to store, treat or dispose of the material.
A trial is set for March 4 in U.S. District Court in Pocatello.
