SANDPOINT, Idaho -- A northern Idaho judge has dismissed a felony vandalism charge against a Bonner County man accused of slashing chair lift seat cushions at Schweitzer Mountain Resort.
Magistrate Court Judge Justin Julian on Wednesday dismissed the charge against David Donald Markwardt.
Julian ruled that prosecutors failed to show during a preliminary hearing that the damages exceeded $1,000, the threshold that elevates a misdemeanor into a felony.
Resort officials in court documents say more than 60 seats were slashed since the 2011 season causing $8,000 in damage.
At the hearing evidence of vandalism was introduced from last season, but no evidence was introduced concerning previous seasons.
Juilan ruled that threw into doubt whether there was enough damage to warrant a felony charge.
