Judge's wife charged in burglary case

POCATELLO -- The wife of a magistrate judge in eastern Idaho has been charged with two counts of felony burglary for allegedly breaking into two homes to get prescription drugs.

Marian D. Evans, 56, appeared in 6th District Court Monday and was informed of the charges. She is the wife of Magistrate David Evans and the Idaho State Journal reports she is scheduled to be arraigned Dec. 18.

The Idaho Attorney General's office was asked by the Oneida County Attorney to handle the case to avoid potential conflicts of interest.

Marian Evans is accused of illegally entering two residences in Malad between Oct. 7 and Oct. 14, 2009.

Messages left at the Evans' home and for David Evans at the Oneida County Courthouse were not immediately returned Tuesday.

She previously pleaded guilty in 2002 to felony possession of a controlled substance.
