BOISE – Ada County prosecutors have amended the complaint against a Boise man who is accused of killing a friend with a punch to the face.
Joshua Luman, 26, is now charged with second degree murder.
Luman was originally charged with involuntary manslaughter after police say he punched Noah Hopper, 26, of Boise, who later died.
Boise Police say Hopper and friends were drinking at the bandshell at Julia Davis Park in the early morning hours of Sept. 7, 2009.
Officers say Luman struck Hopper, who fell and hit his head. Afterwards, he was taken to a Boise home.
Later that day, after not being able to wake Hopper, the others, including Luman, took him to the hospital.
He was pronounced dead the next morning.
Prosecuting attorney Barbara Duggan could not reveal any details of why the charge was amended. Those details will come out in court.
On Thursday, Luman waived his right to a preliminary hearing and case was moved to 4th District Court.
Luman will be arraigned before Judge Timothy Hansen on Dec. 4. He could enter a plea at that time.
If found guilty of second degree murder, Luman could face up to life in prison.
